Terms & conditions

This site, promptman.app (hereafter referred to as PromptMan, site, or website) is owned and operated by Healcy.App UG (haftungsbeschränkt) (hereafter referred to as PromptMan, we, or company).

Please carefully read, review, and understand our Terms and Conditions before using any services or products from promptman.app. Your access to and use of this website and its products indicate that you accept and agree to be bound by these terms and conditions.

If you do not agree with these terms, you should leave the site immediately and not use any of the materials or services available here.

1. Limitation of liability

Under no circumstances shall PromptMan or Healcy.App UG (haftungsbeschränkt) be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data, profits, or business interruption, arising out of the use, or inability to use, the materials on this site, even if PromptMan or an authorized representative has been advised of the possibility of such damages.

If your use of materials from this site results in the need for servicing, repair, or correction of equipment or data, you assume all associated costs.

Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) intent or gross negligence (Vorsatz oder grobe Fahrlaessigkeit); or (d) any other liability that cannot be limited or excluded under applicable German law.

2. License

PromptMan services, platforms, and tools are provided under a commercial license agreement. Each subscription or license purchased includes access to updates and support according to the selected plan.

License activation is necessary to receive updates and premium support. You are not permitted to resell, redistribute, or offer PromptMan products or services, modified or unmodified, without our written consent.

PromptMan Pro is offered on a subscription basis (monthly or annual). Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off or the subscription is canceled at least 24 hours prior to the renewal date. You can manage or cancel your subscription at any time via your Apple App Store / iTunes Account Settings.

3. Ownership and liability

All PromptMan products, solutions, and materials remain the intellectual property of Healcy.App UG (haftungsbeschränkt). You may not claim ownership of our services, whether modified or unmodified.

Our products and services are provided “as is” without warranty of any kind, expressed or implied. Healcy.App UG (haftungsbeschränkt) is not liable for any losses or damages resulting from the use or inability to use its products.

User accounts and product licenses are non-transferable . For agencies and development partners: Please ensure your clients purchase their own licenses if they require direct support access.

PromptMan includes features that process and optimize prompts using third-party artificial intelligence engines (e.g., OpenAI). While you retain ownership of the prompts you input, you agree that you are solely responsible for your inputs. We do not warrant or guarantee the accuracy, legality, or suitability of any AI-generated suggestions or enhancements, and we are not liable for any generated content.

4. Refund policy

For any purchases made through the Apple App Store, billing and refunds are managed exclusively by Apple in accordance with Apple's terms and conditions. If you wish to request a refund, you must do so directly through Apple (e.g., at reportaproblem.apple.com).

EU Consumers Right of Withdrawal: If you are a consumer residing in the European Union or European Economic Area (EEA), you have a statutory right to withdraw from purchases. For transactions processed through the Apple App Store, Apple's cancellation policies and right of withdrawal terms apply.

5. Warranty

PromptMan services are provided without any warranty, either expressed or implied. We do not guarantee full compatibility with all browsers, devices, third-party plugins, or external systems. Before purchasing, you may review demos or contact our support team to verify compatibility with your setup.

6. Account termination and suspension

Healcy.App UG (haftungsbeschränkt) reserves the right to suspend or terminate any user account without prior notice for reasons including but not limited to:

  • Abusive, defamatory, or malicious behavior towards PromptMan staff or customers
  • Spreading false information or misleading reviews
  • Unauthorized resale, distribution, or promotion of competitor products
  • Involvement in hacking, spamming, piracy, or illegal activities
  • Security threats due to account compromise or unauthorized sharing

7. Privacy policy

We value your privacy. PromptMan does not sell, rent, or share your personal information with third parties. Your data is used solely for purposes such as:

  • Order processing
  • Account management
  • Billing disputes
  • Fraudulent activities
  • Legal compliance

By using PromptMan services, you consent to the collection and use of your data by our Privacy Policy.

8. Governing law and dispute resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a merchant (Kaufmann), the place of jurisdiction for all disputes arising from this contract is Göttingen, Germany.

The European Commission provides a platform for online dispute resolution (ODR), which you can access here: https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
